GENERAL WARRANTY POLICY

Galaxy International, Inc. extends to its customers the specific warranty coverage granted by the manufacturers and suppliers whose products Galaxy International sells. This coverage includes: (1) OEMs' new part warranties; (2) Repair stations' reconditioned parts warranties; (3) Overhauler's overhauled components warranties; and (4) documents. Applicable invoice and shipping documents are available upon request.

Galaxy International's obligations under the above warranty coverages are limited to the stated terms and conditions of the specific- warranty.

If no manufacturer or supplier warranty exists, or one existed but has expired and is not currently enforced, Galaxy International, Inc. provides the following limited warranty coverage:
This warranty covers any defects in material or workmanship of : (1) new surplus parts and components; (2) reconditioned parts; (3) overhauled components; and (4) materials not otherwise covered. This warranty is valid for all covered defective material, parts, components, or assemblies as follows: (6 months for exciters and electronic articles) and (1 calendar year for all other articles) from Airworthiness Release 8130-3 date, or 1,000 flight hours, whichever occurs first.

Galaxy Internationals' obligations under this Warranty are limited to repair or replacement of any covered material, part component, or assembly, which Galaxy International supplied to Purchaser.

This Warranty is the sole Warranty, either expressed or implied, made by Galaxy International, Inc. By accepting delivery of, and using, any material, part, component or assembly, Purchaser accepts the above limited warranty in place of any other expressed or implied warranties, including merchant liability and fitness for particular purpose. By accepting delivery of, and using, any material, part, component or assembly, Purchaser waives any claims, causes of action, or remedy:

  • 1. For Breach of Contract
  • 2. For Negligence
  • 3. For Product Liability based upon strict liability or negligence, whether actual or imputed; or
  • 4. For incidental or consequential damages, including, without limitation: (a) damages to the aircraft or other property; (b) costs or expenses resulting from required modification to the aircraft parts, components or assemblies; (c) changes in Retirement Lives and overhaul periods; (d) costs and expenses for commercial losses; or (e) lost profits due to loss of use or grounding of aircraft or otherwise.

If Purchaser finds any material, parts, components, or assemblies to be defective in material or workmanship, Purchaser must notify Galaxy International of the defect, in writing, within 30 days of discovering the defect. Simultaneously purchasers must provide Galaxy International, Inc. a copy of the original sales documents and documentation of flight hours.

This warranty is contingent upon the purchaser complying with Galaxy International disposition instructions. Purchaser must return any defective material, parts, components, or assemblies to Galaxy International, pursuant to an executed Return Material Authorization, with transportation charges prepaid. Galaxy International shall, in its sole discretion, either repair or replace the defective part, component, or assembly after Galaxy International determining, to its reasonable satisfaction, the material, part, component or assembly is defective.

This Warranty does not apply to:

  • 1. Any aircraft material, part, component, or assembly, which has been repaired or altered by anyone other than Galaxy International, or its authorized repair facilities.
  • 2. Any aircraft material, part, component, or assembly which has been subjected to; (a) misuse; (b) extreme operating conditions; (c) extreme environmental conditions; (d) negligent damage; or (e) accidental damage.
  • 3. The return of non-defective materials, parts, components, or assemblies.
  • 4. Unused parts returned beyond the returned materials terms of the original sales agreement; or
  • 5. Any aircraft material, part, component, or assembly, which was not purchased from Galaxy international, Inc. No person, corporation or organization is authorized by Galaxy International, Inc. to assume for it any other liability in connection with the sale of its materials, parts, components, or assemblies. This Warranty shall be governed by and construed in accordance with the laws of the State of Arizona, USA.
